MANILA, Philippines – Inutusan ng Supreme Court ang Philippine Amusement and Gaming Corporation (PAGCOR) at Philippines Charity Sweeptakes Office (PCSO) na magbigay ng bahagi ng kanilang kinikita sa Philippine Sports Commission (PSC).
Desisyon ito ng Supreme Court mula sa petition for mandamus na isinampa ni dating Pampanga Congressman at Rain or Shine coach Yeng Guiao noong 2016.
Base rin ito sa mandato ng Republic Act 6847 o ang “The Philippine Sports Commission Act.”
“The Philippine Amusement and Gaming Corporation is ordered to account and remit the full amount of 5% of its gross income per annum, after deduction of its 5% franchise tax, from 1993 to present in favor of the Philippine Sports Commission,” ayon sa desisyong isinulat ni Senior Associate Justice Marvic Leonen.
“Respondent Philippine Charity Sweepstakes Office is ordered to account and remit to the Philippine Sports Commission the 30% representing the charity fund of the proceeds of six sweepstakes or lottery draw per annum, including its lotto draws, for the years 2006 to present.”
Hindi umano sinunod ng PAGCOR at PCSO ang nakasaad sa Section 26 kung saan dapat silang magbigay ng bahagi ng kanilang gross income sa PSC, ayon kay Guiao.
Ang naturang pondo ay mapupunta sa pagsasanay at partisyon ng mga national athletes sa mga international competitions katualad ng Asian Games, Southeast Asian Games at Olympic Games. (REX MOLINES)
